Dyson Replacement Machine Program Terms & Conditions
ACKNOWLEDGEMENT:
THIS PROGRAM IS MANAGED AND OPERATED BY DYSON DIRECT, INC. (“DYSON”) AND ITS AFFILIATES. BY PARTICIPATING IN THIS MACHINE REPLACEMENT PROGRAM (THE “PROGRAM”), YOU (THE “CONSUMER”) ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THE TERMS AND CONDITIONS HEREIN, INCLUDING THE DYSON PRIVACY POLICY, WHICH WILL GOVERN YOUR PARTICIPATION IN THE PROGRAM AND THE REPLACEMENT OF YOUR MACHINE. YOU FURTHER ACKNOWLEDGE THAT YOUR ORIGINAL MACHINE MAY BE RETIRED, RETURNED TO DYSON, OR DISPOSED OF IN ACCORDANCE WITH THESE TERMS AND CONDITIONS.
1. Eligibility
Your participation in this Program is subject to Dyson’s sole determination that you are an eligible Consumer whose original machine qualifies for a replacement under this Program.
This Program is available only to eligible Consumers who have:
Provided proof of ownership and possession of the original Dyson machine satisfactory to Dyson;
Verified through Dyson Customer Service that their original Dyson machine is within its applicable warranty period; and
Completed the required troubleshooting, diagnostic, and repair assessment process.
Dyson reserves the right to request proof of purchase, proof of ownership, and proof of possession of the original machine to verify valid ownership, possession, and warranty status. Verification may include the submission of purchase receipts, machine photographs, machine videos, or participation in a live TECHSEE video diagnostic to examine the machine with a Dyson representative.
2. Replacement Machine
Replacement machines are subject to inventory availability. Participation in this Program does not guarantee that a replacement machine will be available at any given time.
If Dyson determines that a replacement is appropriate, Dyson may, at its discretion:
Provide a free of charge replacement machine of the same model, where available; or
Provide a free of charge comparable replacement model with like or similar functionality where the original model is unavailable.
Replacement machines may be new or refurbished to Dyson quality standards.
3. Warranty Coverage
Warranty Coverage for Replacement Machines:
A replacement machine provided under this Program will receive a new two-year Dyson Limited Warranty beginning on the date the replacement machine is delivered to you. The replacement machine’s warranty is separate from, and does not continue or inherit, the remaining warranty period applicable to the original machine.
Dyson Limited Warranty: The replacement machine’s warranty is subject to the terms, exclusions, and limitations of the applicable Dyson Limited Warranty. Nothing in these Terms and Conditions limits any rights that cannot be waived under applicable law. For additional information, please review the Dyson Limited Warranty.
WARRANTY DISCLAIMER: There are no warranties which extend beyond those stated herein. To the fullest extent permitted by applicable law, any implied warranties relating to your machine, including but not limited to warranty of merchantability or warranty of fitness for a particular purpose, are limited to the duration of this warranty. Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. 4. Retirement of Original Machine
By accepting Dyson’s offer of a replacement machine under this Program, you acknowledge and agree that your original Dyson machine will be permanently retired from warranty coverage when Dyson ships the replacement machine. From that point, the original Dyson machine will no longer be eligible for warranty service, repair, replacement, or any other claim under Dyson's Limited Warranty.
5. Product Safety - Return and Safe Disposal Requirements
Nothing in these Terms and Conditions limits Dyson's ability to take steps reasonably necessary to address product safety, regulatory, quality, compliance, or corrective action concerns.
Product Return: If Dyson determines that the original machine may present a safety, regulatory, or quality concern, Dyson may, at its own discretion, require the return of the original machine.
Product Disposal: Where Dyson instructs the Consumer to dispose of the original machine, the Consumer agrees to timely dispose of the machine in a safe and environmentally responsible manner and in accordance with applicable local laws, regulations, and recycling requirements.
Counterfeit Machines or Suspected Counterfeit Machines: Counterfeit machines are not eligible for this Program. If Dyson reasonably suspects that a machine is counterfeit, Dyson may decline or suspend participation while it reviews the machine’s eligibility and may require additional information or return of the machine. Any counterfeit or suspected counterfeit machine will be handled in accordance with Dyson’s applicable counterfeit-product procedures.
Dyson has legitimate reasons to exercise its right to retain/destroy any counterfeit machine in order to (1) prevent personal injury or damage to property; (2) prevent resale of counterfeit products; and (3) protect the Dyson brand and reputation. 6. Program Limitations
Program Scope and Participation Limitations: This Program is intended solely to address the specific machine approved by Dyson through the diagnostic and assessment process. Participation does not create any ongoing entitlement to future exchanges or replacements.
Authorized Seller Requirements: Because Dyson cannot control the quality of machines sold by unauthorized sellers, this Program applies only to machines that were purchased from Dyson or a Dyson authorized seller in the United States, unless otherwise prohibited by law. Dyson reserves the right to reject claims for machines purchased from unauthorized sellers, including unauthorized internet sites. Dyson Reservation of Rights: Dyson reserves the right to modify, suspend, or discontinue this Program, or rescind an offer for a replacement machine at any time.
7. LIMITATION OF LIABILITY
DYSON IS NOT RESPONSIBLE FOR ANY FAILURES OR DELAYS IN PERFORMING UNDER THIS AGREEMENT THAT ARE DUE TO EVENTS OUTSIDE OF ITS REASONABLE CONTROL. IF YOU ARE A CONSUMER, YOU MAY HAVE CERTAIN ADDITIONAL RIGHTS WITH REGARD TO SERVICES AND PRODUCTS PROVIDED UNDER THIS AGREEMENT. PLEASE REFER TO YOUR LOCAL CONSUMER AUTHORITY FOR MORE INFORMATION ABOUT YOUR RIGHTS. IF NOT COVERED BY THESE RIGHTS, DYSON DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCT NOT BEING AVAILABLE FOR USE, LOST PROFITS, LOSS OF BUSINESS OR FOR LOST, CORRUPTED, OR COMPROMISED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES. EXCEPT AS EXPRESSLY PROVIDED HEREIN, DYSON WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, DYSON IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT OF YOUR ORDER. IN CONSUMER CASES, THE LIABILITY FOR (1) PERSONAL DEATH AND INJURY AND (2) FRAUD MAY BE WIDER THAN NEGLIGENCE CAUSED LOSS AND IN SUCH CASES DYSON DOES NOT SEEK TO EXCLUDE THIS LIABILITY.
8. Consumer Rights
Nothing in these Terms and Conditions limits or excludes any rights that cannot be waived under applicable consumer protection or warranty laws.
9. Governing Law
The Terms and Conditions of this Program are governed and interpreted pursuant to the laws of the State of Illinois, United States of America, notwithstanding any principles of conflicts of law. If any part of the Terms and Conditions is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of remaining provisions.
